As the betting industry grows rapidly in Latin America, Brazil has taken a pivotal role in shaping the region*s regulatory landscape. Luiz Felipe Santoro, President of the Games Commission at the S?o Paulo chapter of the Brazilian Bar Association (OAB-SP), a legal expert in sports and gaming law, sheds light on how Brazil*s new regulatory framework could become a regional model for legalising and managing sports betting regulation.
Although Brazil legalised sports betting in 2018, actual regulation did not arrive until years later. ※The law was passed at the end of 2018,§ Santoro explains, ※but actual regulation didn*t begin until 2024. The regulated Brazilian market only officially started operating in January 2025.§ During this gap, operators functioned in a legal grey zone, exposing consumers and the industry to risks. Now, Brazil*s structured regulatory approach is setting the tone for Latin America*s betting future.
A major concern in the region remains the prevalence of illegal betting platforms. According to Santoro, ※It*s not enough# to regulate the market and supervise legal operators if illegal platforms are still widely active.§ Enforcement and public education must go hand-in-hand. Santoro emphasises that consumers need to recognise and support licensed operators, stating, ※The first step toward building a regulated market# is making sure the public knows which companies are authorised.§
Santoro believes responsible gambling is essential to the sustainability of the industry. ※Without solid and effective responsible gambling measures, the industry as a whole loses,§ he warns. Brazil*s regulatory framework includes tools like self-exclusion, betting volume monitoring and time tracking, all designed to protect users from gambling harm. But Santoro also stresses the importance of preventive efforts, highlighting the need for better public health infrastructure to support those affected. ※Currently# our public healthcare system (SUS) and CAPS# are not equipped to treat gambling addiction,§ he notes.
The rise in sports betting has heightened concerns around match-fixing and integrity in sports. ※Manipulation goes beyond [final results]# it could be something like a player receiving a card,§ Santoro explains. Betting patterns tied to specific in-game events can spark investigations into potential manipulation. Brazil*s system of sports justice allows for strict consequences, including lifetime bans. ※Any penalty issued in Brazil can be reported to FIFA, and FIFA can extend that sanction worldwide,§ he adds.
Santoro concludes by calling for cooperation across all stakeholders. ※We need a collective effort, operators, players and the government, all working together.§ With regulation in place and a clear commitment to responsible practices, Brazil is poised to lead Latin America toward a safer, more sustainable betting industry.
